What is the process for appealing a juvenile court decision?
In Washington, the process for appealing a juvenile court decision is similar to that of criminal court appeals. After the judge has issued a decision in the juvenile court case, the parties involved can appeal the decision to the Division III Court of Appeals in Washington. First, the party wishing to appeal the decision must file a notice of appeal with the original court within 30 days of the judgment, or within an additional period of time if provided by the juvenile court. Next, the court clerk must transmit the record from the juvenile court to the appellate court. The appellant then must file the opening brief within 30 days after the record is filed with the appellate court. All other parties have 30 days to file their answering briefs. The appellant then has a chance to file a reply brief within 14 days after the answering brief is filed. After the briefs are filed, the appellate court holds a hearing to consider the case. Both sides present their arguments in the hearing and the court then issues its decision within a few weeks of the hearing. The decision of the court of appeals can be appealed to the Supreme Court of Washington. The Supreme Court has discretion to decide whether to review the case. If the Supreme Court decides not to review the case, the decision of the Court of Appeals stands.
