What is the Worker Adjustment and Retraining Notification Act (WARN)?

The Worker Adjustment and Retraining Notification Act (WARN) is a federal labor law providing protection to workers and their families by requiring employers to provide 60 days or more advance notice of plant closings and mass layoffs involving more than 50 employees at one site. WARN provides workers who are laid off with the opportunity to seek other employment and get the necessary training necessary for such employment. In Arizona, WARN applies to any employer who has more than 50 full-time employees for each working day during at least 20 weeks in the current or preceding calendar year. An employer must provide written notification to affected workers, their representatives, and the local government at least 60 calendar days in advance of any plant closing or mass layoff. The notification must provide information on the number of employees impacted, their job functions, and the length of the layoff or plant closing. WARN also requires that employers provide displaced workers with severance pay and other benefits, a summary of their rights under the Act, and information about how to obtain assistance with finding new employment. Additionally, WARN applies to certain relocations and reductions in hours. If an employer fails to provide proper notice, the affected employees may be entitled to receive back pay and a limited amount of benefits. Employees who believe their rights under WARN have been violated may file a complaint with the National Labor Relations Board (NLRB) or take legal action in state or federal court.
