What is the Lilly Ledbetter Fair Pay Act?

The Lilly Ledbetter Fair Pay Act is a labor law in Mississippi that is designed to protect employees against pay discrimination based on gender, race, and other characteristics protected by the law. Named after its namesake, the Ledbetter Fair Pay Act was the first major piece of legislation signed by President Obama in 2009. It overturned a Supreme Court decision which found that employees had only 180 days to file a pay discrimination complaint after the first discriminatory paycheck was received, regardless of when the employee found out about the discriminatory pay. The Ledbetter Fair Pay Act protects employees from discriminatory pay from any employer, regardless of size. It also protects applicants from discrimination during the job-seeking process. It requires employers to pay employees equally for equal work, regardless of gender, race, religion, or national origin. The law also requires employers to keep records of their workforce, including job titles, salaries, and performance ratings, in order to make sure employees are being paid fairly and equally. It also requires employers to include a description of how it handles complaints of pay discrimination in its employee handbook. In addition to protecting employees from pay discrimination, the Ledbetter Fair Pay Act also makes it illegal for employers to retaliate against employees who complain about pay discrimination, or who help someone else file a complaint. This is important, as it helps ensure that employees can feel confident in coming forward if they believe they are being treated unfairly.
