What are the laws concerning discrimination in the workplace?
In North Dakota, employers must follow the laws of the United States with regards to discrimination in the workplace. The law prohibits discrimination on the basis of race, color, sex, national origin, religion, age, disability, and genetic information. Employers are also prohibited from discriminating against an employee based on their citizenship status. The Equal Employment Opportunity Commission (EEOC) enforces these laws by taking complaints from individuals who feel they have been discriminated against. The EEOC will investigate any such complaints and, if necessary, file suit on behalf of the complainant. Additionally, the EEOC has published guidelines that provide employers with a framework to follow when making hiring, firing, and promotional decisions. Employers must also ensure that employees are protected from a hostile working environment. Under the law, employees must not be subjected to unwelcome or offensive language, jokes, or conduct based on any of the protected characteristics listed above. Employers must also make reasonable accommodations for disabled employees in order to protect them from discrimination. The North Dakota Department of Labor also provides resources on discrimination in the workplace, including guidelines on how employers should handle complaints from employees. Furthermore, the Department offers seminars and workshops to educate employers on how to handle discrimination issues in the workplace.
