Are employers obligated to provide employees with pensions?
In the District of Columbia, employers are not obligated to provide employees with pensions. However, there are certain circumstances in which employers are encouraged to offer pension benefits, such as when there are collective bargaining agreements in place, when employees participate in an employee stock purchase program, or when employers agree to provide pension benefits in a written contract. Under the Employee Retirement Income Security Act (ERISA), employers are generally required to provide retirement plans to their employees, though the types of plans they provide are up to the discretion of the employer. ERISA also sets out specific rules and guidelines for regulating these plans. Employers must also comply with the District of Columbia’s Human Rights Act, which requires employers to provide reasonable accommodations for employees with disabilities who request assistance in the form of an additional pension. In short, while employers are not obligated to provide pensions in the District of Columbia, there are certain circumstances in which employers may be required to offer them to their employees. It is important for employers to be aware of their obligations and the applicable laws in order to ensure that they are in compliance.
