What is the “dram shop law”?
The “dram shop law” is a type of liquor liability law in California. It holds establishments that serve alcohol responsible for any injuries or damages resulting from individuals who become intoxicated. This includes both drivers who cause car accidents and other people who have caused harm to property or people due to their intoxication. Under California law, the person or establishment that provided the alcohol can be found liable for any damages if it is determined that they were negligent in doing so. For example, if a bar served alcohol to a patron who was already visibly intoxicated, they would be held liable for any damages resulting from that patron’s actions. There are also laws that limit the amount of alcohol an establishment can serve to any single customer, in order to help prevent them from becoming too intoxicated. If a bartender serves a customer more drinks than they are allowed, they may be held liable if any harm results from it. The “dram shop law” is an important tool for holding establishments accountable for any harm caused due to over-serving customers or other negligent behavior.
