Are there any special rules or regulations related to promotions or discounts related to alcoholic beverages?

In New Mexico, special rules apply to alcoholic beverage promotions or discounts. All drink specials must comply with state law, including those related to pricing and advertising. According to the state Retail Liquor Prohibitions Law, no licensee is allowed to offer any type of discount of any sort on any type of alcohol. In addition, promotions such as “all you can drink” or “buy one get one free” are prohibited. Additionally, any promotion or discount related to the sale of alcoholic beverages must be approved by the Alcohol and Gaming Division of the New Mexico Regulation and Licensing Department. In order to be approved, the promotion or discount must not encourage excessive or irresponsible drinking, must not target a particular demographic, and must not offer a discount or promotion that cannot be applied to non-alcoholic items. In addition, any advertisement or promotion related to alcoholic beverages must follow the advertising guidelines set by the state, which include no advertising of beverages below the legal drinking age and no marketing of “binge drinking”. Failure to adhere to the laws and regulations regarding alcohol promotions and discounts in New Mexico may result in legal action or fines.
