Are there any laws related to serving alcohol at special events or festivals?
In West Virginia, there are laws related to serving alcohol at special events or festivals. The West Virginia Code states that it is illegal for any person to sell or serve alcohol to any person under the age of 21 or to a person who is apparently intoxicated. If an organization or individual is found to be in violation of these laws, they may be held civilly liable and face monetary damages for civil liabilities related to the service of alcohol at a special event or festival. The West Virginia Liquor Control Act requires any person or organization that intends to sell or serve liquor or non-intoxicating beer at any special event or festival to first obtain a Special Non-Intoxicating Beer and/or liquor license from the West Virginia Alcohol Beverage Commission (ABC). Organizers of special events or festivals also need to obtain a license if they intend to allow people to bring their own liquor. Organizers of special events or festivals that involve the service of alcohol must abide by certain regulations and restrictions. For example, persons under the age of 21 are not allowed to purchase or consume alcohol and all alcohol must be consumed on the premises. The organizer of the special event or festival must also ensure that all staff and volunteers are properly trained on the laws related to alcohol service. Organizers of special events or festivals must also take reasonable steps to prevent over-serving and the sale or service of alcohol to minors, intoxicated persons, and persons who are unable to make responsible decisions about consuming alcohol. Failure to abide by any of these laws can result in civil and criminal penalties.
