What is the difference between federal, state and local law?
The differences between federal, state, and local law are distinct. Federal law is the highest form of law in the United States, and applies to all 50 states. These laws are established by the federal government, and any state or local law which conflicts with federal law is not valid. State law is created by each individual state, and applies to all matters within that state. This includes crimes, civil matters, and administrative matters. Local law is law created by cities, counties, and towns. This can include ordinances, regulations, and zoning laws. In South Carolina, local law must always be in accordance with state law. South Carolina considers local laws to be subordinate to state law. If a conflict were to arise between a local and state law, the state law would take precedence and the local law would be rendered invalid. Federal law applies in South Carolina just as it applies to the rest of the United States. In other words, no matter what the local or state law states, federal law always prevails.
