In California, the state government, not local government, is mainly responsible for the regulation of public transportation fares. However, local governments do have some authority over fares within their jurisdiction. The California Public Utilities Commission (CPUC) has the primary responsibility for setting public transit fares for inter- and intra-county buses, railroads, shuttles, and more. This commission is authorized to set fares, approve fare changes, and establish safety regulations. Additionally, the Short Distance Passenger Transportation Act of 2011 (AB 1388) gives local governments the authority to approve the fare rates set by transportation entities. This includes private coach carriers, such as vans and limousines. In order to set fair and equitable fares, California law requires that public transportation entities consider the costs associated with providing transit service, the ridership of the transportation entity, and the availability of other transportation services and rates. Local governments can also enter into agreements with public transportation providers to set fares and service levels, as long as the agreement meets certain requirements. For example, the agreement must not provide for a fare disparity among different riders and must not be far below the cost of providing the services. All in all, there are numerous laws related to the regulation of public transportation fares in California. While the California Public Utilities Commission has the primary responsibility for setting public transit fares, local governments do have some authority over fares within their jurisdiction.
