How do I challenge a union election?

In Virginia, if you are challenging a union election, you must first file an Election Objection with the Virginia State Labor Relations Board. This must be done within seven days after the election results are announced. In the objection, you must state the reasons why you believe the election was not fair or valid. Once the objection is filed, the Labor Relations Board will investigate your claims and will hold a hearing, if necessary. During the hearing, both sides will be given the opportunity to present evidence and testimony in support of their positions. The Labor Relations Board will then determine if the election should be overturned or if it stands as originally recognized. If the board rules that the election was unfair or invalid, the board may order a new election. In this new election, the board will require that certain procedures be followed to ensure a fair and just election. Ultimately, the decision of the Virginia State Labor Relations Board is final and there is no way to appeal their decision.
