What is a labor arbitration hearing?
A labor arbitration hearing is a process in which a neutral third party, known as an arbitrator, hears arguments and evidence from both sides of a labor dispute. The arbitrator then makes a decision that is binding to both parties. In North Carolina, labor arbitration hearings are governed by the North Carolina Binding Arbitration Act and the North Carolina Arbitration Rules. In North Carolina, labor arbitration hearings are often used by employers and unions to resolve disputes between them that arise from collective bargaining agreements or other contracts between them. Labor arbitration hearings can also be used to settle grievances arising from individual employee contracts, such as wrongful termination disputes. A labor arbitration hearing begins when one of the parties files a request for arbitration with the American Arbitration Association (AAA). The AAA will then appoint an arbitrator and will also set the date, time, and place of the hearing. At the hearing, the parties will have the opportunity to present their case and call witnesses or submit evidence. The arbitrator will consider the information, arguments, and evidence presented by both parties and will then make a decision. The decision will be binding upon both parties, and they must comply with the decision.
