What is the Worker Adjustment and Retraining Notification Act?

The Worker Adjustment and Retraining Notification Act (WARN Act) is a federal law that requires employers in Arizona to provide workers and their representatives with at least 60 days’ notice of a plant closing or other mass layoff. WARN applies to businesses with at least 100 employees, including all federal, state, and local government agencies. Under the WARN Act, employers must give written or electronic notice to employees, their representatives, as well as local and state government officials. The required notice must include the date of the layoff or closure, the name and address of the affected site, a list of the job classifications to be affected, and a statement of the right to apply for state or federal rapid-response services. Additionally, employers must provide employees with compensation and benefits for the period of the notice before the layoff or closure. The WARN Act also prohibits employers from retaliating against employees for exercising their rights under the law. It is important to note that while the WARN Act applies to businesses with 100 or more employees in Arizona, state laws may provide broader protections for employees.
