What are the rules regarding eviction?
Eviction is the process by which a landlord removes a tenant from the rental property. In California, the landlord must have a valid cause to evict a tenant, such as failure to pay rent or violating terms of the lease. The landlord must provide a written notice to the tenant that specifies the reason for eviction and the date by which the tenant must vacate the premises. The length of notice required for eviction for failure to pay rent is three days, while the notice period for all other causes is 30 days. If the tenant does not leave the property within the required notice period, the landlord may file an Unlawful Detainer action with the local court. The court will hear the case and render a decision. If the court issues a judgment in favor of the landlord, the tenant will be required to leave the property. Even if the tenant has left without an order, the landlord must still file the judgment. If a tenant fails to leave within five days of the judgment, the landlord may have the tenant removed by the local sheriff. The landlord must also abide by all local, state, and federal laws regarding the manner in which an eviction is carried out. These laws govern the time of day an eviction may take place, the number of people who may be in attendance, and any applicable fees.
