What can a landlord do if a tenant is late on rent payments?

Under New Hampshire landlord and tenant law, a landlord can take action if a tenant is late on rent payments. The first step the landlord can take is to send the tenant a written notice of the late payment. This notice will include the amount of the late payment and the date by which the tenant must pay the amount due. If the tenant does not pay the amount due by the specified date, the landlord may pursue legal action. Under New Hampshire law, the landlord can file a civil suit in court in order to recover the amount due. If the action is successful, the court may order the tenant to pay the amount due, in addition to any court costs and other applicable fees. The court may also issue a judgment against the tenant in the amount of the unpaid rent. In some cases, the landlord may also be able to collect the past-due rent from the tenant’s security deposit. If the tenant’s security deposit is not sufficient to cover the amount due, the landlord may then pursue legal action against the tenant. In addition, the landlord may also be able to terminate the lease and evict the tenant if the tenant is more than one month late on rent payments. If this situation arises, the tenant must be given a written notice at least 30 days in advance of the lease termination. A tenant who fails to pay the past-due rent within this period may then be evicted.
