What type of notice must a landlord provide when increasing a tenant’s rent?
According to the North Dakota Century Code, a landlord must provide written notice to the tenant prior to increasing the rent. This written notice must include: the amount of the notice, the effective date of the rent increase, and a statement indicating that the tenant may file a complaint with the North Dakota Attorney General if they believe the increase is unjustified. The landlord is also required to provide the tenant with a minimum of 10 days written notice before the rent increase takes effect. However, if the tenant’s lease gives the landlord the authority to increase the rent, the landlord must follow the rules and requirements listed in the lease. In addition, a landlord must also provide 60 days written notice prior to terminating or not renewing a tenant’s lease. This tenant protection law applies to all residential rental agreements and leases, including month-to-month leases. A landlord may also be subject to penalties if they don’t provide adequate notice of a rent increase or when terminating a tenant’s lease.
