What is the tenant’s right to access the rental property after the lease has expired?

In California, a tenant’s rights to access a rental property after the lease expires depend on the type of tenancy. If the tenant has a periodic tenancy, then the tenant can remain in the rental until either the tenant or the landlord gives the other notice of their intention to terminate the agreement. However, if the tenant has a fixed-term lease, then the tenant’s rights to access the rental property are terminated once the lease has expired. The landlord is allowed to treat the tenant as a trespasser if the tenant remains in the rental after the lease has expired. If this is the case, the landlord can restrict the tenant’s access and take steps to evict the tenant. The tenant can also be held liable for any unpaid rent if they remain in the property after the lease has expired. If the tenant wishes to remain in the rental after the lease has expired, they must negotiate a new lease or arrangement with the landlord. If no new agreement is made, then the tenant must vacate the property. Tenants must also be sure to provide the landlord with a written notice of their intention to terminate the tenancy at least thirty days before the lease ends. This will help ensure that the tenant is not held liable for any more rent or damages.
