What is the tenant’s right to access the rental property after the lease has expired?

In Pennsylvania, after a lease agreement expires, the tenant is still allowed access to the rental property. This is known as “holdover tenancy.” However, the landlord has the ultimate say in whether or not they will allow the tenant to remain in the property. If the landlord wishes to terminate the lease, they may give the tenant a written notice to vacate the property. If the landlord allows the tenant to remain in the property past the expiration of the lease, the tenant is considered to be in a month-to-month tenancy. In this situation, the tenant has the right to stay in the property as long as they continue to pay rent, and the landlord must honor the terms of the original lease. It is important for tenants to understand that the landlord may choose to terminate a month-to-month tenancy at any time. However, the landlord must provide written notice to the tenant at least 30 days before they must leave the property. The tenant can also terminate the tenancy at any time, but they must provide the landlord with written notice at least 15 days prior to when they plan to move out. In general, the tenant has the right to access their rental property after a lease has expired. However, this may be limited by the terms of the current agreement and the landlord’s wishes. The tenant should be sure to understand the rights and obligations that come with their tenancy agreement, and ensure they are following the relevant Pennsylvania laws.
