Are there any laws governing the use of tenant background checks?
Yes, Missouri has laws governing the use of tenant background checks. The Missouri Residential Landlord and Tenant Act, § 441.500 RSMo., states that a landlord may conduct a tenant background check prior to renting to a tenant, but each party must consent to the background check in writing. The background check must also include a credit report, criminal history, and any other information that the landlord deems relevant to making a decision about whether to accept the tenant. Additionally, the tenant must be provided with a copy of all information obtained in the background check. If a landlord is using a tenant screening company, the company must also comply with any applicable state laws and regulations, including those of Missouri. In particular, Missouri laws require the company to provide the tenant with a copy of all reports and an explanation of the tenant’s rights in regards to correcting or disputing the accuracy of the information contained in the report. Finally, Missouri laws prohibit the use of certain information in determining whether to accept or reject a tenant, such as race, gender, or religion.
