What is land use law?

Land use law, also referred to as zoning law, is the legal framework for controlling the use of land in a particular area. In Texas, land use law is implemented at the local level, generally through a city or county’s comprehensive land use plan. This plan establishes different zones of land use, which control what activities can take place in each zone. For example, the plan might designate an area as primarily residential, while designating another area as primarily commercial, meaning the latter area is identified for activities like large-scale retail stores or industrial businesses. It also helps to conserve land by preventing development that would make an area less suitable for its originally intended purpose. For instance, a manufacturing area might have restrictions on the types of businesses that can be built there, so it doesn’t get developed into a residential area. In Texas, land use law is regulated by the State Legislature, as well as local government bodies like City Councils and County Commissions. This means that each municipality can customize a land use plan that works best for its needs. Land use law is an important tool for ensuring that areas are developed responsibly, and that the environment and natural resources are protected.
