What is the process for getting a marriage annulled?
In California, a marriage annulment voids a marriage so that it is considered invalid as if it never happened. The process of getting a marriage annulled is different from the process of getting a divorce, and it must meet certain legal requirements. The first step in getting a marriage annulled is to hire an attorney and file a petition for annulment. The petitioner is the spouse who is asking for the annulment, and the respondent is the other spouse. In the petition, the petitioner must state why they believe the marriage was invalid, such as if one spouse was already married at the time of the marriage, if the marriage was entered into under duress, or if one spouse was not of legal age. The petition also includes a request for the court to declare the marriage annulled. After the petition is filed, the respondent is served with a copy and has the opportunity to respond with their own filing. The court will then review both parties’ documents and arguments, then decide whether to grant or deny the annulment. Once the court makes its decision, both parties have an opportunity to appeal if they don’t agree with the decision. If the annulment is granted, the court will issue a decree that officially ends the marriage and both parties must comply with the annulment. The court may also address issues such as child custody and division of property.
