In order to obtain a marriage license in Texas, there are certain legal requirements that must be met. First, both parties must be 18 years of age or older and not be currently married. If either person is under 18, he or she must obtain parental consent, and present a certified copy of their birth certificate. If either person has been divorced, then the Decree of Divorce must be presented at the time the license is requested. Both parties must also provide a valid form of identification such as a driver’s license, state-issued ID, passport, or military ID. Both parties must also appear in person before the county clerk and provide the necessary identification and documents. The fee for obtaining a marriage license in Texas varies from county to county and generally ranges from $50 - $120. After paying the fee, the couple will be issued a marriage license. This license is valid for 30 days from the date of issuance and must be presented at the time of the ceremony. The marriage ceremony must take place in Texas and must be performed by an authorized individual such as a licensed or ordained minister, priest, rabbi, judge, or Justice of the Peace. Two adults must also be present to witness the ceremony. After the ceremony, the officiant must sign and return the marriage license to the county clerk where it was issued. The clerk will then register the marriage and issue a certified copy of the marriage license.
