What are the legal consequences for unlicensed possession of medical marijuana?

In Washington, unlicensed possession of medical marijuana carries serious legal consequences. Under Washington state law, medical marijuana must be prescribed by a healthcare provider, and only authorized and registered patients of certain medical conditions, who are at least 21 years of age, are allowed to possess medical marijuana. Possession of medical marijuana without proper licensing is a criminal offense. If a person is caught with more than one ounce of medical marijuana without a valid license, they could face a misdemeanor charge. This could result in up to 90 days in jail, and/or a fine of up to $1,000 for a first offense. If convicted of subsequent offenses, the penalties will increase with potential jail time of up to 1 year and/or a fine of up to $5,000. Additionally, possessing, selling or delivering medical marijuana to someone else without a license is a felony offense. This carries the potential of up to five years in prison and/or a fine of up to $10,000. If a minor is caught with medical marijuana, they could face juvenile delinquency charges, which could result in court-ordered probation or placement in an out-of-home facility. For these reasons, it’s important for Washington residents to understand and abide by the medical marijuana laws. It is illegal to possess or distribute marijuana without a valid license, and any violation of these laws carries serious legal consequences.
