How does the court determine the amount of damages in a medical device injury case?
When a medical device injury case is taken to court, the court is tasked with determining the amount of damages that are owed to the plaintiff for their injury. This determination is based on a few key factors. The court first looks at the severity of the injury that the plaintiff sustained from the medical device. This includes looking at both the physical and emotional damages that the injury has had on the plaintiff. This can include medical bills, lost wages, physical and emotional pain and suffering, and other factors that the court deems relevant to the case.
