How is mediator neutrality maintained?
Mediator neutrality is essential in the mediation process, since it allows parties to trust that the mediator is unbiased and will represent their interests fairly. In Texas, mediator neutrality is maintained by following a code of conduct set out by the Texas Mediation Trainers Roundtable (TMRT). The code of conduct states that mediators must be unbiased and not give legal opinions to either party. Mediators must also respect the confidentiality of the mediation and not disclose any information to anyone outside of the mediation process. The TMRT also requires that mediators remain impartial and objective throughout the mediation process. This means that they should not take sides or advise any party on their position. The mediator should provide a safe and supportive environment for each party to feel comfortable expressing his or her opinion. Finally, mediators must remain focused on the objectives of the mediation while at all times respecting the rights of the parties involved. They must not try to influence the outcome of the mediation and should not disclose any information to any party outside of the mediation process. By following these guidelines, mediators ensure that they remain neutral and that the mediation process is fair and just for all parties involved.
