What is the right to refuse electroconvulsive therapy?

In Virginia, individuals have the right to refuse electroconvulsive therapy (ECT), which is also known as shock therapy. This particular mental health law is outlined in the Virginia Code, Sections 54.1-2990.1 and 54.1-2990.2. ECT is used to treat certain mental health conditions such as depression or the symptoms of bipolar disorder and schizophrenia. During ECT, electrical currents are passed through the brain to induce a seizure. This seizure helps to reset the brain and can help with severe mental health issues. However, Virginia law gives individuals the right to refuse ECT if they wish. This means that no one can force them to undergo ECT if they decline, even if the healthcare provider believes it is in the individual’s best interest. ECT is a powerful treatment and so, the right to refuse is important to ensure that individuals are not forced into undergoing ECT without their consent. In order to refuse ECT in Virginia, individuals must be capable of making informed decisions, meaning that they must understand the nature of ECT and the risks associated with it. They also must be willing to sign a written document outlining their refusal to ECT. The document must be signed and witnessed by two people who are not related to the individual. Once all of these steps have been completed, the individual’s right to refuse ECT is legally binding.
