What if my employer does not provide an adequate working environment?

If your employer fails to provide an adequate working environment, you may have a legal claim under Florida maritime injury law. Depending on the circumstances, this may entitle you to pursue a legal claim against your employer for failing to comply with safety and health regulations. Under the federal Jones Act, you may be entitled to pursue a claim for damages in the form of lost wages, medical expenses, pain and suffering, and other economic losses. Additionally, if your employer was particularly egregious in its negligence, you may be also be entitled to punitive damages. In order to be successful in your lawsuit, you must be able to prove that your employer failed to provide an adequate working environment. This can include evidence that the employer violated safety standards and regulations, or failed to keep equipment in a safe working order. You must also be able to show that you were injured due to the working environment and that it is the employer’s fault. If you are injured while working and believe your employer has not offered an adequate working environment, speak with an experienced maritime lawyer. They will help you understand your rights and determine if you have a viable claim. In some cases, they may also be able to negotiate with your employer directly to ensure you receive compensation for your injuries.
