What is an Article 15 offense?

An Article 15 offense is a disciplinary action issued by a commanding officer of a military service member. It is the most common form of non-judicial punishment allowed by the United States Uniform Code of Military Justice (UCMJ). Article 15 provides a commanding officer with the authority to punish certain types of misconduct without having to refer the charges to a court-martial. An Article 15 typically applies to service members who violate rules and regulations, including those related to unprofessional behavior, failure to obey orders, minor offenses, and minor disciplinary infractions. The punishment can include reducing a service member’s rank, withholding or delaying promotions, or taking away certain privileges. In Washington State, service members who face Article 15 prosecutions have the right to request a hearing. In the hearing, the service member has the opportunity to present evidence and arguments in support of their innocence or in favor of a reduced sentence. The commanding officer has the final authority to determine whether to impose an Article 15 and, if so, the terms of the punishment.
