What is the UCMJ Article 120?
UCMJ Article 120 is a part of the Uniform Code of Military Justice (UCMJ) and governs sexual offenses committed by members of the U.S. Armed Forces stationed in New York. The Article addresses rape, sexual assault, aggravated sexual contact, abusive sexual contact, forcible pandering, aggravated sexual abuse, and any attempts or conspiracies to commit such offenses. The Article defines rape as a person (or persons) forcing another to engage in a sexual act through the use of physical force, without consent, or with someone who is mentally or physically incapable of giving consent. Sexual assault is defined as a sexual act committed without consent. Aggravated sexual contact entails the infliction of physical injury or severe mental or emotional trauma in the course of committing sexual contact. Forcible pandering involves forcing or persuading someone to engage in prostitution or provide sexual services, either for monetary gain or sexual gratification, without their consent. Aggravated sexual abuse falls into the same category, but it involves the use of force or threats of force to compel the victim to engage in sexual activity. Any form of nonconsensual sexual contact committed by members of the U.S. Armed Forces while on duty in New York can result in serious consequences, up to and including court-martial, dishonorable discharge, and a potential federal prison sentence.
