What is the UCMJ Article 138?

The Uniform Code of Military Justice (UCMJ) Article 138 is the legal provision which grants active duty members of the military in Tennessee the right to petition for redress of grievances. This article allows for a member of the armed forces to submit a written complaint to their commanding officer regarding any matter which affects them without fear of retribution or reprisal. The commanding officer must then take the complaint seriously and make a determination regarding the merits of the grievance and how to best address the issue. If the commanding officer determines the grievance is valid, they may take whatever action they deem necessary to address the grievance. If the complainant is unsatisfied with the commanding officer’s decision, they may then appeal the decision to a higher-ranking officer.
