What is a post-trial review article in a court-martial?

A post-trial review article is an article from the Uniform Code of Military Justice (UCMJ) that provides an avenue for individuals facing court-martial in Utah to have their case reviewed. Post-trial reviews are a way for the court to ensure that laws and regulations have been properly applied and that an appropriate sentence has been imposed. When a court-martial has been completed and all appeals have been exhausted, the accused may be able to have a post-trial review article considered. Post-trial reviews are adjudicated by the court-martial convening authority - the designated military commander who oversees the court-martial process. The commander will then review the findings, the sentence, and any other relevant matters and may modify, remand, affirm, or set aside the original findings or sentence. The post-trial review article can also be used by the accused to have their case reviewed if they were found guilty and sentenced to a severe punishment such as a dishonorable discharge or a jail sentence of more than a year. In Utah court-martial proceedings, the accused has the right to appeal the findings of the court-martial to a higher authority. If they choose to, the accused can also ask the court-martial convening authority to review the case by using the post-trial review article. Post-trial reviews are an important part of the military justice system because they provide an avenue for individuals facing court-martial in Utah to have their case reviewed to ensure justice has been served.
