What is the Military Rules of Evidence (MRE)?

The Military Rules of Evidence, or MRE, are a set of rules that govern the use of evidence in military courts in California. MRE is designed to ensure that the process of putting on a trial in a military court is fair and just. The MRE governs such matters as the use of evidence and witnesses, the discovery process, what kind of evidence is admissible, the challenges that may be made to the evidence, the burden of proof, and the taking of depositions. The MRE is based on the Federal Rules of Evidence, but some of the rules have been modified to take into account the unique nature of the military justice system. For example, the MRE takes into account the fact that military personnel are subject to the Uniform Code of Military Justice (UCMJ) and have the right to remain silent, which the Federal Rules of Evidence do not address. The MRE also establishes certain privileges to protect members of the military, such as the marital privilege in which a spouse cannot be forced to testify against their partner. The MRE also includes special rules to protect classified information from being disclosed in a court of law. Overall, the MRE is an important part of the military justice system in California, and it helps to ensure that all parties are treated fairly and justly in a military court.
