What is the Military Rules of Evidence (MRE)?
The Military Rules of Evidence (MRE) are a set of regulations that govern the prosecution and defense of military personnel in court-martial proceedings in Virginia. The MRE provide the court with the authority to decide the admissibility and relevancy of evidence presented during a court-martial. The MRE are more stringent than the Federal Rules of Evidence (FRE), which apply to non-military proceedings. The MRE include provisions related to the admissibility of evidence, the competency and qualifications of witnesses, and the weight given to evidence. For example, the MRE requires that all evidence be reliable, relevant, and material to the case before it can be submitted in court-martial proceedings. In addition, the MRE permits the court to consider evidence obtained from hearsay, which is not allowed under the FR. The MRE also provides the court with the authority to exclude irrelevant and inadmissible evidence, as well as evidence obtained in violation of an individual’s legal rights. Additionally, the MRE limits the scope of cross examination in court-martial proceedings and requires that any evidence that is obtained in violation of the accused’s military rights must be excluded. The MRE are designed to ensure a fair and just trial in court-martial proceedings in Virginia. By following the MRE, the court-martial system can provide an efficient and effective legal process for prosecuting and defending military personnel.
