What is the Uniform Code of Military Justice (UCMJ) Article 99?

The Uniform Code of Military Justice (UCMJ) Article 99 relates to the judicial procedures for nonjudicial punishment. Nonjudicial punishment is a form of disciplinary action which allows commanders to take disciplinary action against military members for minor offenses without having to refer the matter to a court-martial. UCMJ Article 99 sets out the conditions under which nonjudicial punishment may be imposed. This includes requiring that the commanding officer providing the punishment must be legally allowed to do so based on their rank and position, that the punishment is appropriate, and that the soldier receives timely notification of the punishment as well as a record of the proceedings. Additionally, the article limits the types of punishments that can be issued and states that the accused must be afforded the opportunity to make a statement in defense of their actions. Nonjudicial punishment can include punishments such as restriction, corrective training, and/or counseling, as well as reduction in rank and loss of pay. In cases where a soldier feels they are unjustly punished for an offense, they are also afforded the right to appeal the decision to a higher authority, which may subsequently result in the reversal of the nonjudicial punishment. Overall, UCMJ Article 99 plays an important role in outlining the procedures for nonjudicial punishments and helping to ensure that soldiers are treated fairly when disciplinary action is taken against them.
