What is a maritime lien?
A maritime lien is a legal claim on a vessel or its cargo. It is a type of security interest and allows the party with the lien to recover money or property from the vessel or its cargo if the owner does not pay a debt. In Ohio, maritime liens are governed by the Ohio Revised Code and the Federal Maritime Lien Act. Maritime liens arise when the owner or operator of a vessel owes a debt related to the vessel and fails to pay it. Examples of debts that can give rise to a maritime lien include back wages owed to a crewmember, damages caused to a dock, repairs made to the vessel, and services or supplies provided to the vessel. Maritime liens can have a priority over other creditors in collecting money from the vessel. If the vessel is seized or sold, the party with the lien has the right to be paid first. Generally, maritime liens in Ohio will only be enforceable if the party with the lien files a lawsuit in the appropriate court. Maritime liens are an important tool to ensure that parties are paid for services or supplies provided to a vessel. By understanding how maritime liens work in Ohio, parties can protect their legal rights if they are owed money from a vessel or its cargo.
