What is the law of salvage?
The law of salvage is a maritime law which states that an individual or entity who rescues property from the sea or from some other peril is entitled to a reward from the owner of the property or from those that benefit from the rescue. This law has been around for centuries and has been a part of New York law since the 1700s. The law of salvage states that if an entity or individual renders services that save property from destruction or damage, then they are entitled to a reward from the owner of the property or those who benefit from the services. This reward is usually determined by the court based on the extent of the services rendered. Generally, the higher the risk an individual or entity takes on while rescuing property, the larger the reward they are entitled to. In New York law, the court generally considers a few factors when determining the reward. These factors include the time, labor, and expense involved in the salvage, the value of the property rescued, the degree of danger encountered, the skill required for the rescue, and the skill used in conducting the operation. The law of salvage provides important protection for individuals who take major risks to save property and encourages individuals to take action, even if it is dangerous and expensive. This law also allows for the owners of the property to remain safe while their property is rescued. This law helps to ensure that individuals or entities who contribute to the preservation of property are not unfairly deprived of a just reward.
