What is the scope of the United Nations Convention on the Rights of the Child?
The United Nations Convention on the Rights of the Child (UNCRC) is an international agreement that establishes a comprehensive set of rights for children. It sets out the civil, political, economic, social, health and cultural rights of children, and provides a framework for governments to ensure those rights. The Convention applies to all children regardless of their race, color, sex, language, religion, political or other opinion, national, ethnic or social origin, property, disability, birth or other status. In regards to Maritime Law in New York, the scope of the UNCRC is vast. It ensures that all children within the State of New York are afforded proper protection and same rights. It particularly relates to the protection that children must have when they are travelling as passengers on a ship, and outlines the duties of the ship’s crew to ensure the safety of the child. The Convention also covers the issue of children’s rights when they are involved in the activities of maritime law enforcement or are employed as crew members on vessels. Furthermore, the Convention may also be interpreted as providing protection for the rights of children who have been victims of criminal acts or accidental injury suffered on board a ship or in a port in New York State. This includes the right to be given health care and other assistance in the event of such an incident. Also, the Convention applies to the protection of a child’s best interests when decisions pertaining to their legal guardianship and custody are being made. Finally, the Convention also provides protection for the rights of children not yet born. In particular, it states that a mother is entitled to a healthy pregnancy and delivery, and that the child is entitled to a safe and secure environment. This means that Maritime Law in New York must be respectful of these rights and ensure that pregnant women and young children are safe from any kind of harm during their journeys.
