What is the scope of the International Maritime Organization’s International Ship and Port Facility Security Code?

The International Maritime Organization’s (IMO) International Ship and Port Facility Security (ISPS) Code is an international maritime security measure designed to protect ships, ships’ crews, and port facilities from security threats, ranging from terrorism to more common criminal activities. The ISPS Code applies to all seagoing ships over 500 gross tonnage, their crews, and port facilities in the Port State, which includes Illinois. The ISPS Code is divided into two main parts; Part A outlines the minimum security requirements for ships and port facilities, while Part B outlines the procedures to be followed in order to implement the security requirements set out in Part A. The security requirements outlined in Part A involve the designation of ship security officers, implementing security measures based on risk assessment, information gathering and analysis, as well as the collection of records and documentation of security measures taken. Part B of the ISPS Code outlines the organisational and operational requirements concerning the development and implementation of a Ship Security Plan, which is basically a detailed plan of the security measures to be taken in order to meet the minimum security requirements. Additionally, it sets out the procedures for the verification of the implementation of the Ship Security Plan, and the training and qualifications of shipboard personnel and port facility personnel. In addition to the International Maritime Organization’s (IMO) International Ship and Port Facility Security Code (ISPS Code), Illinois may impose additional security requirements of its own. Such additional requirements would need to be consistent with the international standards set out by the IMO in the ISPS Code.
