How are bids and contracts awarded by a municipality?
In New York, bids and contracts awarded by municipalities are regulated by the Public Authorities Law. Under this law, government officials are obligated to seek out competitive bids when selecting vendors and contractors for projects. In order to be eligible to enter a bid for a project, vendors must register with the municipality and be pre-qualified based on their experience, resources, and financial stability. Once bids have been submitted, the municipality must open and read the bids in a meeting open to the public. At the meeting, each bid must be evaluated and scored according to specific criteria established by the municipality. After all the bids have been evaluated, the contract is awarded to the vendor or contractor who submitted the highest-scoring bid. However, the municipality also has the option to reject all bids, or to negotiate with the highest-scoring vendor or contractor for a lower price. In some cases, the municipality may also be allowed to use its discretion when awarding a contract. This means that the municipality may take factors other than the lowest bid into consideration, such as the vendor’s experience or ability to complete the project in a timely manner. In New York, a municipality is required to keep all records related to the bidding and contracting process open for public viewing. This ensures that the process is fair for all vendors and contractors. Furthermore, it keeps the municipality accountable and helps ensure that taxpayer dollars are being used efficiently.
