What is the liability of a municipality for negligence?

In Texas, municipalities can be held liable for negligence if the action or inaction of an employee or other representative of the municipality causes an individual harm. This is commonly referred to as “municipal liability.” The state of Texas recognizes that municipalities possess a legal obligation to taxpayers in providing certain services, such as police and fire protection, sewage treatment, and water supply. Municipal liability in Texas mandates that the municipality must be found at fault for the negligence and the individual claiming damages must have suffered actual losses, such as medical bills or lost wages. A plaintiff can claim part or all of the municipality’s negligence in the form of a lawsuit. To succeed, the plaintiff must prove that the municipality’s negligence was the direct result of the harm they suffered. In addition, the municipal government must be found to have acted negligently by failing to take reasonable action to protect the citizens from foreseeable risks. For example, if the municipality failed to properly repair a broken street light and a car accident occurred due to poor lighting, the municipality could be found liable for the accident. In conclusion, municipalities in Texas have a legal duty to protect citizens from foreseeable risks. If they fail to do so, they may be held liable for any damages resulting from their negligence.
