What is the procedure for initiating a referendum in a municipality?
In order to initiate a referendum in a municipality in Oklahoma, there are several steps that must be taken. The first step is to identify the issue to be put before the voters. It can be an ordinance, a constitutional amendment, or a law enacted by the legislature, but must have a direct effect on the citizens of the municipality. Once the issue has been identified, a petition must be prepared and circulated to obtain signatures from registered voters of the municipality. The petition must include the signatures of at least 15% of the estimated number of legal voters who voted in the last municipal election, as well as descriptive and accurate statements of the issue to be presented on the referendum. After the petition has been circulated and the required number of signatures have been obtained, it must be filed with the county election board of the county in which the municipality is located. The election board will then either verify the signatures and certify that the petition is sufficient, or declare that it is insufficient. Once the petition has been certified, the county election board will establish the date of the election and mail ballots to all registered voters within the municipality. If a majority of the voters approve the issue, it will become law in the municipality. If it is not approved, it will not become law.
