What is the Indian Child Welfare Act?

The Indian Child Welfare Act (ICWA) is a federal law aimed at protecting the welfare and wellbeing of Native American children by preserving their tribal connections. This law gives tribes the right to intervene in cases involving the custody of Native American children, ensuring that these children are placed in the care of family members, members of the tribe’s community, or, in some cases, another Native American tribe. This law was passed in 1978 and applies to Native American children living in Tennessee and elsewhere.
