What is the Indian Education Act?

The Indian Education Act is a federal law that was passed in 1972 to help improve the educational opportunities experiences of Native American students in the United States. This act also provides funding for programs that are specific to Native American students in California. The Indian Education Act (Public Law 92-318) is also known as Title IV of the Indian Self-Determination and Education Assistance Act and is administered by the Office of Indian Education Programs under the United States Department of Education. This act mandates that states receiving federal funding must create an Indian Education Program (IEP) that must provide resources to ensure that American Indian students receive a quality education and culturally relevant services. The IEP must also be tailored to meet the unique needs of the students and their families, such as language, culture, and history. In California, the IEPs are aimed at improving academic performance for Native American students. It also works to improve the transition rates from high school to college and careers by providing supportive services such as individualized academic plans, after-school programs, mentoring, and cultural activities. The Indian Education Act also recognizes tribal sovereignty and mandates that schools must consult with knowledgeable tribal members to ensure compliance with the objectives of the act. Other initiatives that are funded through this act include parent and community involvement, curriculum development, Native American language instruction, and the formation of advisory committees to ensure the successful implementation of programs. Ultimately, the Indian Education Act works to ensure that Native American students in California receive the quality education they deserve and have the same opportunities that all other students have.
