What is the Indian Land Consolidation Act?

The Indian Land Consolidation Act (ILCA) is an important piece of federal legislation aimed at providing Native American tribes with the opportunity to regain control of their land. This legislation was enacted in 1994 in order to enable tribal governments to consolidate fractionated or fractionally owned trust and restricted lands. When land is fractionally owned, it is divided up among the different owners of the tribal trust land. This makes it difficult for tribes to use this land as a resource. For example, it is difficult to lease tribal trust lands for income, or to develop them for residential or economic development when the land is divided among a large number of owners. The ILCA provides a mechanism for tribes to consolidate fractionally owned trust and restricted lands into a single parcel under the ownership of the tribe. This consolidation of land gives tribes control over their land and allows them to develop it for economic development. The benefits of this process include increased revenue for Native American tribes and improved services for the members of the tribe, such as health care and education. The ILCA has been a great success in Oregon. In 2002, the state passed the Oregon Indian Land Consolidation Act, which allowed Oregon’s nine federally recognized tribes to consolidate their fractional trust and restricted land ownership. This act has enabled the tribes to take control of their lands and has allowed them to develop and use them for economic development. This act has been a great success in Oregon and has enabled Native Americans to retain their traditional lands and gain much needed economic resources.
