What is the difference between premises liability and a negligent security case?
Premises liability and negligent security cases are both personal injury lawsuits which involve the liability of a property owner. The difference between the two is that premises liability covers any injury that occurs on the property due to the owner’s negligence, while negligent security cases are more specific and involve injuries sustained as a result of inadequate security measures on the owner’s premises. In a premises liability claim, an injured party must demonstrate that the property owner failed to use reasonable care and that this failure was the cause of their injury. The injured party must also be able to show that the owner should have been aware of the hazardous condition due to their knowledge of the property or their duty to inspect for dangerous conditions. In Texas, an injured party may be able to recover medical costs, lost wages, and other damages from the property owner. A negligent security case, on the other hand, requires the injured party to prove that the property owner failed to provide adequate security measures. They must also be able to show that the owner was aware of, or should have been aware of, a foreseeable risk of harm and that their failure to address the risk lead to the injury. The injured party may also be able to recover medical costs, lost wages, and other damages from the property owner if they prove that the property owner was negligent. In short, premises liability covers any injury that occurs on a property due to the owner’s negligence, whereas a negligent security case is specifically related to inadequate security measures on the owner’s premises.
