What is the difference between premises liability and a negligent security case?

Premises liability and negligent security cases involve the responsibility of a property owner to keep visitors safe while on their property. However, there is an important difference between the two. Premises liability is a type of tort law that holds property owners accountable for the safety of those on their property. Property owners must maintain a certain level of safety that is expected by anyone who visits. This includes ensuring the property is not in disrepair, dangerous items are not lying around, and access to certain areas of the property is limited. In Virginia, negligent security cases are based on the law found in the Virginia Premises Liability Act. Negligent security cases involve claims of harm caused to a visitor to a property due to the property owner’s failure to provide adequate security measures. This can include failing to provide lighting, secure locks, or security cameras. In order to succeed in a negligent security case, it must be proven that the property owner acted unreasonably and failed to provide adequate security measures that a reasonable property owner would have provided in similar circumstances. Therefore, while both premises liability and negligent security cases involve property owners’ responsibility to provide visitors with a safe environment, the legal difference between the two is the reasonableness of the security measures provided by the property owner.
