What are the legal requirements concerning the use of trademarks and logos by a nonprofit organization?
In South Dakota, nonprofit organizations are required to follow certain laws in order to use trademarks and logos. These laws are set forth in South Dakota Codified Laws Title 47, Chapter 28A. A nonprofit organization must first obtain permission from the United States Patent and Trademark Office to use any trademarks or logos. The nonprofit organization must register the marks and logos with the USPTO in order to receive legal protection in the state of South Dakota. The nonprofit organization must also use the trademarks and logos in accordance with the terms of the United States Trademark Act. This act prohibits unauthorized use of deceptive or confusingly similar marks, and requires that the nonprofit maintain the quality of the marks and logos in the marketplace. Furthermore, the nonprofit must ensure that the marks and logos are not used in a way that could cause confusion or mislead the public. For example, the nonprofit must not represent or imply that there is an affiliation or endorsement with another person or organization if the nonprofit is not in fact affiliated with that person or organization. The nonprofit must also not use confusingly similar marks or logos as those of another organization or person. Finally, the nonprofit must include an appropriate disclaimer when it uses the marks and logos. This disclaimer should indicate that the use of the marks and logos does not imply any sponsorship, affiliation, or endorsement by any other organization or person. This disclaimer serves to protect the nonprofit from liability and legal action.
