Yes, there are criminal penalties for nursing home abuse in Washington. According to the Washington Administrative Code, “Each person, firm or corporation that commits any form of abuse or neglect of a person in a nursing home…shall be held criminally liable and upon conviction shall be sentenced to a maximum of ten years of imprisonment, a fine not to exceed $50,000, or both.” Moreover, if the victim has died due to the nursing home abuse, the perpetrator can be charged with a class A felony and “shall be sentenced to a maximum of twenty years imprisonment, a fine not to exceed $100,000, or both.” There are also civil penalties provided in the law. If the perpetrator is found guilty of civil negligence, the victim or their family is entitled to compensation for the damages caused by the abuse. This can include physical, psychological, economic, and/or medical damages. Depending on the severity of the abuse, the court may also award punitive damages to the victim, which are intended to punish the perpetrator. It is important to remember that all nursing home employees should be held accountable for any abuse or neglect of a resident. As such, it is important to take all necessary measures to report any cases of abuse and ensure that the law is being enforced, which includes filing lawsuits if necessary.
