What types of compensation can I receive in a nursing home abuse case?
In Washington, if you have been a victim of nursing home abuse, you may be eligible to receive compensation for your injuries and emotional harm. Depending on the nature and extent of your injury, you may be able to recover damages for medical expenses, lost wages, pain and suffering, emotional distress, and other damages. In some cases, punitive damages may be sought as well. In addition, you may be able to recover both economic (out-of-pocket) and non-economic damages. Economic damages include medical bills and out-of-pocket expenses related to the injury, as well as any lost income due to the injury. Non-economic damages are awards for pain and suffering, emotional distress, and loss of enjoyment of life. You may also be able to seek punitive damages, which are not intended to compensate the victim, but rather to punish the wrongdoer and deter future misconduct. Punitive damages are rare, however, and will only be available if it can be proven that the nursing home acted with malice and disregard for the safety of residents. If there is clear evidence of criminal abuse, you may also be able to seek restitution from the perpetrator. Restitution is typically awarded to reimburse the victim’s out-of-pocket costs (such as medical costs) resulting from the abuser’s conduct. Ultimately, the type and amount of compensation a nursing home abuse victim receives depends on the facts of the case. Therefore, if you believe you have been a victim of nursing home abuse, it is important to speak to an experienced attorney as soon as possible.
