Are nursing homes required to perform a background check on employees?
In Minnesota, all nursing homes are required to perform background checks on all employees that have contact with residents. The Minnesota Department of Health requires nursing homes to perform a background check on any employee who works with clients in the facility. This includes direct care staff, such as nurses, aides, and any other staff who perform hands-on care. It also includes administrative and managerial staff. The background check must include a criminal history check from the Minnesota Bureau of Criminal Apprehension, a check of any disciplinary actions taken by the Minnesota Board of Nursing or other licensing boards, and a check of any past abuse or neglect that has been substantiated by the Department of Human Services. The background check must be received before the employee is allowed to begin work, and must be updated every three years. In addition to the background check, nursing homes in Minnesota must also comply with the requirements of the Nursing Home Abuse Prevention Act. This act requires them to provide ongoing training for staff on how to prevent and appropriately respond to reports of abuse in the facility. They must also have policies in place that allow residents to report incidents of abuse or neglect, and must ensure that all staff members are aware of those policies.
